EC1935/2004 and FDA legislation

What is the EC1935/2004 and FDA legislation?

EC1935/2004 is the European legislation governing materials and objects that come into contact with food. These materials are also known as food contact materials (FCM). FDA is the American version of this legislation. According to EC1935/2004, the migration of substances from the materials used into the foodstuffs must not exceed certain limits. This prevents the materials contaminating the foodstuffs and causing their organoleptic characteristics to deteriorate. In the Netherlands, the Dutch Food and Consumer Product Safety Authority (NVWA) is responsible for enforcing compliance with the legislation.

The importance of EC1935/2004 and FDA legislation

Until 2004, FCM legislation varied greatly from country to country. This not only caused confusion, it put public health in jeopardy. Foods produced in a country with less strict FCM rules were more at risk of becoming contaminated with substances that could damage our health. In 2004, the European Union decided to introduce uniformity into the laws and legislation surrounding these FCMs. The result is the EC1935/2004. Every European country must comply with this legislation. This allows us to protect ourselves against hazardous substances that could otherwise end up in our food.

Good Manufacturing Practice (EC2023/2006)

The EC1935/2004 and FDA legislation are used to establish if a material is suitable for coming into contact with specific foodstuffs. To ensure that these materials suffer no harmful handling during production, guidelines have been laid down in the Good Manufacturing Practice legislation (EC2023/2006). These guidelines safeguard the handling of the product during production.  In addition, the traceability and handling of the materials are safeguarded in our GMP production system.

 

Declaration of Compliance

According to the EC1935/2004 and FDA legislation, our tested materials have been found suitable for a number of specific foodstuffs. This can be found in our Declaration of Compliance (DOC). The Declaration of Compliance is available on request. This allows us to guarantee traceability, and we can immediately provide the right document that inspection authorities such as the NVWA might request.
